Please read these Terms and Conditions ("Terms") carefully before accessing or using Findably.app (the "Service"). By creating an account or using the Service, you ("User," "you," or "your") agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.

1. Definitions

For purposes of these Terms, the following definitions apply:

"Findably," "we," "us," or "our" means the operator of Findably.app, its parents, subsidiaries, affiliates, successors, and assigns.
"Service" means the Findably.app platform, website, APIs, tools, and all related features, including AI-powered SEO and GEO content generation, content crawl and refresh, keyword research, and publishing integrations.
"User Content" means any content, data, or materials you submit, upload, or provide to the Service, including URLs, website content, brand guidelines, or instructions.
"Generated Content" means any content produced by the Service using artificial intelligence models on your behalf, including articles, meta descriptions, headings, and other outputs.
"GEO" means Generative Engine Optimization — the practice of optimizing content for visibility in AI-driven search and answer engines such as ChatGPT, Perplexity, Google SGE, and similar platforms.
"Subscription" means a paid plan granting access to the Service as described on our pricing page.

2. Changes to These Terms

We may revise these Terms at any time. If we make material changes, we will notify you by email or via a prominent notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Service and cancel your Subscription.

3. Eligibility & Account Registration

To use the Service, you represent and warrant that you:

Are at least 18 years of age and legally capable of entering into binding contracts;
Have the authority to bind any company or organization on whose behalf you are using the Service;
Have not been previously suspended or removed from the Service; and
Will provide accurate, current, and complete account information and keep it updated.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access.

4. Description of the Service

Findably provides an AI-powered platform for SEO and GEO content creation and optimization. The Service may include:

AI-generated blog posts, articles, and web copy optimized for search engines and generative AI platforms;
Automated crawling, analysis, and refresh of your existing website content;
Keyword research, topic clustering, and content gap analysis;
Internal linking recommendations and on-page optimization suggestions;
Publishing integrations with third-party CMS platforms (e.g., WordPress, Webflow, Shopify); and
Performance tracking and reporting dashboards.

No Guarantee of Rankings or Results. Findably does not guarantee any specific search engine rankings, AI engine citations, organic traffic volumes, conversion rates, revenue, or other SEO or GEO outcomes. Search engine and AI platform algorithms are subject to change without notice, and results will vary based on factors outside our control, including your website's authority, competition, and technical infrastructure.

5. AI-Generated Content

5.1 Nature of Generated Content

The Service uses large language models (LLMs) and other AI systems to generate content. Generated Content may contain inaccuracies, errors, or content that requires review. You are solely responsible for reviewing, editing, fact-checking, and approving all Generated Content before publication or use. Findably is not liable for any damages arising from your use of unreviewed Generated Content.

5.2 Ownership of Generated Content

Subject to your compliance with these Terms and payment of applicable fees, you own the Generated Content produced on your behalf by the Service. Findably retains no ownership rights in Generated Content delivered to you. However, you acknowledge that AI-generated outputs may not be protectable under copyright law in all jurisdictions, and you assume all risk related to the legal status of Generated Content.

5.3 Content Crawl & Refresh

When you use our content crawl and refresh features, you grant Findably permission to access, crawl, and process your website's publicly accessible content solely for the purpose of generating optimization recommendations and refreshed content versions. We will not republish or share your crawled content with third parties except as necessary to operate the Service.

6. Licenses & Intellectual Property

6.1 Our Platform

The Service and all underlying technology, software, interfaces, and platform content (excluding User Content and Generated Content) are owned by Findably or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during the term of your Subscription.

6.2 Your User Content

You retain full ownership of your User Content. By submitting User Content to the Service, you grant Findably a worldwide, royalty-free, non-exclusive license to use, process, reproduce, and adapt your User Content solely to the extent necessary to provide and improve the Service. We will not use your User Content to train general-purpose AI models accessible to third parties without your explicit consent.

6.3 Feedback

If you provide feedback, ideas, or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation to you.

7. Acceptable Use & Prohibited Conduct

You agree not to use the Service to:

Violate any applicable law, regulation, or third-party rights, including search engine webmaster guidelines;
Generate, publish, or distribute content that is defamatory, obscene, misleading, fraudulent, or infringing on any intellectual property rights;
Reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying AI models of the Service;
Scrape, harvest, or extract data from the Service using automated means not expressly authorized by us;
Resell or sublicense access to the Service without our prior written consent;
Use the Service to develop a competing product or service; or
Interfere with or disrupt the integrity or performance of the Service, servers, or networks.

Findably reserves the right to suspend or terminate your access immediately if we determine, in our sole discretion, that you have violated this Section.

8. Fees, Payment & Subscriptions

8.1 Subscription Fees

Access to paid features requires a Subscription. Fees are as stated on our pricing page at the time of purchase and are subject to change. We will provide at least 30 days' notice before any price change affects your active Subscription.

8.2 Payment Processing

Payments are processed by LemonSqueezy, our third-party payment provider. By completing a purchase, you also agree to LemonSqueezy's terms of service. Findably does not store your full payment card information. We are not responsible for errors, outages, or failures caused by LemonSqueezy.

8.3 Billing & Renewals

Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel your Subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then.

8.4 Refund Policy

First-time subscribers may request a full refund within 7 calendar days of their initial payment by contacting [email protected]. Refunds are limited to one per customer. After the 7-day window, all fees are non-refundable. We do not provide prorated refunds for unused portions of a billing period.

9. Third-Party Services & Integrations

The Service may integrate with or rely on third-party platforms, including CMS providers, AI model providers, search data APIs, and analytics tools. Findably is not responsible for any outages, errors, data loss, policy changes, or limitations attributable to third-party services. Your use of any third-party service remains subject to that provider's terms and privacy policies. If you connect your CMS or other platforms, you represent that you have the authority to grant us the access necessary to publish content on your behalf.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by applicable law, Findably expressly disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated outputs. Findably does not warrant that: (a) the Service will meet your requirements; (b) the Service will be uninterrupted, secure, or error-free; (c) Generated Content will be accurate, original, or free from third-party claims; or (d) the Service will improve your search rankings, GEO visibility, traffic, or revenue.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Findably and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, loss of business opportunity, or cost of substitute services, arising out of or in connection with these Terms or the Service, even if advised of the possibility of such damages. Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid to Findably in the twelve (12) months immediately preceding the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Findably and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service in violation of these Terms;
Your User Content, including any claim that it infringes third-party rights;
Your publication or use of Generated Content without appropriate review; or
Your violation of any applicable law or regulation.

13. Term & Termination

These Terms are effective from the date you first access the Service and remain in effect until your Subscription or access is terminated. Either party may terminate at any time. Findably may suspend or terminate your access immediately and without prior notice if we believe you have materially breached these Terms. Upon termination, your license to use the Service ends immediately, but Sections 5.2, 6.1, 6.3, 10, 11, 12, 14, and 15 shall survive.

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the United Mexican States (Mexico), specifically the applicable federal commercial and civil laws, without regard to conflict-of-law principles.

14.2 Informal Resolution

Before initiating any formal dispute proceedings, you agree to contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least 30 calendar days.

14.3 Jurisdiction

If a dispute cannot be resolved informally, both parties submit to the exclusive jurisdiction of the competent courts of Mexico City (Ciudad de México), Mexico. You waive any objection to such jurisdiction or venue.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable Subscription order forms, constitute the entire agreement between you and Findably regarding the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer any rights under these Terms without our prior written consent. Findably may assign its rights and obligations under these Terms without restriction.

15.5 Language

These Terms are drafted in English. In the event of any inconsistency between an English version and a translated version, the English version shall prevail.
